Terms of Service

Terms of Service

These terms apply to purchases and services provided through this store by NoCloudGPT. Product-specific descriptions, license terms, and written service terms presented at purchase are incorporated into these terms where applicable.

1. Nature of the service

terminal.glass Pilot is an attended technical installation and private-AI deployment service for a supported customer-controlled Linux host. Unless a product description expressly states otherwise, NoCloudGPT does not sell or provide the customer’s computer, server, virtual machine, cloud hosting account, internet service, or other underlying hardware or hosting.

2. Customer responsibilities

The customer is responsible for providing accurate system information, a supported environment, adequate hardware and storage, required administrator authorization, backups of important data, and lawful authority to install software on the target system. The customer remains responsible for the security and administration of systems and accounts under the customer’s control.

3. Deployment and activation rights

A terminal.glass purchase grants only the NoCloudGPT or terminal.glass rights expressly described in the applicable offer and license terms. Additional users, computers, servers, virtual machines, deployments, or other capacity are not included unless expressly stated.

4. Third-party software and open-source components

terminal.glass deployments can incorporate third-party software and open-source components, including Ollama, Open WebUI, and AI models selected for the customer’s environment. Third-party software remains owned by its respective owners and remains subject to its own licenses and terms. Purchase from NoCloudGPT does not transfer ownership of third-party software.

Open WebUI is an independent third-party project. Open WebUI is not owned by NoCloudGPT, and NoCloudGPT and terminal.glass are not represented as being affiliated with, endorsed by, or maintained by the Open WebUI project.

5. AI models and outputs

AI model availability, speed, capabilities, storage requirements, and quality vary by model, hardware, software version, and configuration. AI-generated output can be incomplete, inaccurate, or unsuitable for a particular purpose. Customers are responsible for reviewing outputs before relying on them for consequential decisions.

6. COLORS.chat for Mac UI and Beta software

COLORS.chat macOS pre-release or Beta software is separate from a terminal.glass Linux purchase unless an offer expressly states otherwise. NoCloudGPT may separately invite eligible customers to complimentary Beta participation at its discretion. Beta software may contain defects, change substantially, lose features, require updates, or be discontinued before a final release.

7. Remote access and security

Any remote access used during an attended installation must be authorized by the customer and is limited to work reasonably necessary to provide the purchased service. Customers should not send passwords, private keys, recovery codes, or other sensitive credentials through ordinary email.

8. Scheduling and cooperation

Attended services require reasonable customer availability and cooperation. Delays caused by unavailable access, unsupported systems, missing permissions, or materially inaccurate system information can require rescheduling or a revised service scope.

9. Cancellations and refunds

Cancellations and refund requests are governed by the store’s Cancellation & Refund Policy and applicable law.

10. No guarantee of uninterrupted or error-free operation

To the extent permitted by law, software and technical services are provided without a guarantee that every model, third-party component, network configuration, or customer workload will operate without interruption or error. NoCloudGPT will provide the installation and support expressly included in the purchased offer.

11. Limitation of liability

To the maximum extent permitted by applicable law, NoCloudGPT will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from a purchase or use of the service. To the maximum extent permitted by law, NoCloudGPT’s aggregate liability arising from a specific purchase will not exceed the amount paid to NoCloudGPT for that purchase. These limitations do not apply where prohibited by law.

12. Intellectual property

NoCloudGPT, terminal.glass, COLORS.chat, and their proprietary materials remain the property of their respective owner. Third-party names, marks, software, and other materials remain the property of their respective owners.

13. Changes

NoCloudGPT may update these terms for future purchases as products and services evolve. The terms applicable to a completed purchase are subject to the version presented or otherwise made available in connection with that purchase, except as required by law.

Nothing in these terms limits consumer rights or other rights that cannot legally be waived.
